The legally binding agreements between a service provider and its users that outline the rules, responsibilities, and limitations for using a service

By submitting the online order form, or by using IndicHosts.net's Service, Customer hereby agrees to IndicHosts.net's Terms of Service (TOS), Acceptable Use Policy (AUP), No Spam Policy (NSP), and Privacy Policy.

Unless otherwise specified, in this TOS, the AUP, the NSP, and the Privacy Policy, the usage of "us", "we", "our", and "ours" shall refer to INDICHOSTS.NET, the registered trade name under GSTIN 07AAGPF0452K1ZZ, a business based in New Delhi, India, and its successors and assigns. The usage of "you", "your", "they", and "them" shall refer to the Customer of IndicHosts.net.

Moreover, in this TOS, the AUP, the NSP, and the Privacy Policy, "IndicHosts.net" shall refer to the same business and its successors and assigns.

Customer agrees that it shall comply with this TOS, IndicHosts.net's Acceptable Use Policy (AUP), and IndicHosts.net's No-Spam Policy (NSP). Customer further agrees that it has read IndicHosts.net's Privacy Policy and agrees to all the terms and conditions in the Privacy Policy. In this document, the word "Agreement," with a capital "A," refers to the TOS, the AUP, the NSP, and the Privacy Policy collectively.

1. General Terms. In consideration of hosting services to be delivered, Customer agrees to be bound by the following terms and conditions:

1.1. Customer agrees to pay, in advance of each monthly service term, for hosting services to be rendered.

1.2. Customer agrees to be bound by the service term selected on the online order form or via applicable promotional codes that may require Customer to order IndicHosts.net's service for a certain minimum period of time.

1.3. Refunds are governed by Section 6 of this TOS. Hosting service plans carry a 30-day money-back guarantee; outside that guarantee, setup fees and web hosting service fees for the paid term are non-refundable.

1.4. Non-payment of services shall result in a 5-day notice of disconnection. All payment failures must be cured within 5 business days from the invoice due date or the account will be suspended. Account termination will result from invoices overdue for 30 days.

1.5. IndicHosts.net is not and shall not be responsible for data integrity for any accounts that are terminated, disconnected, or interrupted because of Customer's failure to pay for IndicHosts.net's services.

1.6. Customers agree to pay all taxes applicable to their account.

1.7. Promotional discounts apply to the initial term only. Your renewal price is displayed before payment and in your order confirmation. IndicHosts.net generates renewal invoices twenty-one (21) days before the service renewal date. Where automatic payment is enabled, the saved payment method will ordinarily be charged on the invoice due date, not on the invoice-generation date. Customers may disable automatic payment or cancel an eligible renewal before the due date, subject to the applicable cancellation policy. If a standard-price change will increase your renewal price, IndicHosts.net notifies you at least thirty (30) days before the renewal date — that is, before the invoice-generation date — and the notice states the current service, the revised renewal price, applicable taxes, the invoice-generation date, the payment due date, and the deadline to cancel or downgrade. Pricing is guaranteed for the period of prepayment of service.

2. Agreement for Services.

2.1. IndicHosts.net will provide, and Customer will purchase and pay for, the Web hosting services (the "Services"), according to the service fees specified in the Order for the applicable Service Description. Customer acknowledges that the service, and service fees have been communicated to the Customer, and that Customer is aware of all applicable charges as per the Agreement. Customer also understands that no promotional offers will apply to their individual service unless said promotional offers are specified in this Agreement.

3. Payment.

3.1. Establishment and provision of service is contingent upon receipt of payment from Customer to IndicHosts.net.

3.1.1. Customer must pay in full for the Services before Indichosts.net begins to provide the Services to Customer. Renewal invoices are generated twenty-one (21) days before the service renewal date. Where automatic payment is enabled, Customer agrees that the saved payment method will ordinarily be charged on the invoice due date — not on the invoice-generation date — and that Indichosts.net may apply the amount due to the payment method listed on file on or after that due date. See Section 1.7 for the renewal-price notice that precedes any automatic charge.

3.1.2. Setup fees will be charged and are due at the time of the Customer's initial request of the Services requiring setup.

3.2. Payment is due on the defined monthly recurring billing date. All returned checks will be charged a $20.00 service fee. Service will be interrupted on accounts that reach 5 days past due. Accounts that are not collectable by IndicHosts.net will be turned over to an outside agency for collection. If your account is turned over for collection, you agree to pay to IndicHosts.net a "Processing to and Collection" Fee of not less than Fifty ($50.00) Dollars nor more than One Hundred Fifty ($150.00) Dollars.

4. Delinquent Accounts.

IndicHosts.net may temporarily deny service or terminate this Agreement upon failure of Customer to pay charges when due. Such termination or denial will not relieve Customer of responsibility for the payment of all accrued service fees, and any collection fees to which IndicHosts.net may be entitled under this Agreement or applicable law.

5. Account Cancellation.

Customers may voluntarily cancel their account at any time, for any reason or no reason, by filling out the "Cancellation Request Form" which is provided on the IndicHosts.net Website. You can find the "Cancellation Request Form" at the following Web page:

Once a Customer has cancelled their account before the renewal date, no more charges will be billed to the account. Cancellations on or after renewal will be charged renewal fees.

PayPal paying customers cancelling their PayPal subscription payment does not warrant cancellation of service. All cancellations must go through the cancellation form. Customer can terminate their account for any reason or for no reason. On cancellation, unused prepaid value is converted to account credit, calculated as: the hosting fees paid for the current prepaid term (excluding setup fees, domain registrations, taxes, and fees for third-party services) multiplied by the number of whole unused days remaining in that term, divided by the total days in that term. Credits do not expire, have no cash value, are non-transferable, and apply automatically toward future invoices with IndicHosts.net. Cash refunds are not provided on cancellation, except under the 30-day Money Back Guarantee described in Section 6.

6. Refunds and Disputes. Hosting service plans carry a 30-day Money Back Guarantee, described below. Except for that guarantee and the account credit described in Section 5, payments to IndicHosts.net are non-refundable.

Refunds, credits and money-back guarantees apply only to eligible service fees. Taxes, duties, levies and similar government charges are non-refundable, except where a refund or adjustment is required by applicable law or processed through a valid tax credit note.

Setup fees, and fees for a completed service term, are non-refundable regardless of usage. All billing disputes must be reported within thirty (30) days of the time the dispute occurred. Disputed charges to your credit card issuer, also known as chargebacks, which, in Indichosts.net's sole discretion, are invalid under the terms and conditions of this Agreement, will result in service interruption, and reconnection fees to restore the desired service.

Money Back Guarantee: Without waiving any of its other rights under this Agreement, Indichosts.net, offers to its Customers a 30-day money-back guarantee on fees for shared and managed hosting plans only (the "Money Back Guarantee"). Dedicated servers are governed by the Dedicated Server Terms of Service and do not carry a money-back guarantee. If for any reason you cancel your account by filling in the account cancellation form and submitting it to Indichosts.net, within thirty (30) days of the beginning of your service, Indichosts.net, will refund your money with no questions asked; provided, however, that you have never previously obtained a refund under the money-back guarantee. If you have ever previously obtained a refund under the money-back guarantee, your account will be cancelled, but no money will be refunded to you.

Please note that the amount refunded to you will be the amount you paid for hosting services only, and will not include any of the following fees:

1. 1. Setup fees,
   2. Fees for domain name registrations,
   3. Fees charged for exceeding your allotted disk storage space or bandwidth,
   4. SSL certificate fees,
   5. Web design fees,
   6. Website marketing fees,
   7. Any add-on services, features, software, and
   8. Any other fees for services involving a third party.

The 30-Day Guarantee is subject to all of the following limitations:

1. 1. You are entitled to a maximum of one (1) 30-Day Guarantee.
   2. If you do not cancel your account within thirty (30) days of the beginning of your service, your right to the 30-Day Guarantee shall expire forever and may not be revived under any circumstances, without the prior express written approval of Indichosts.net.
   3. You may not transfer or assign the 30-Day Guarantee to any third party.
   4. You agree that you will not circumvent the restrictions on the 30-Day Guarantee described in this document, or attempt to circumvent those restrictions by any means, including, but not limited to, the following actions:
      1. 1. Creating multiple accounts, using the same customer name or different customer names;
         2. Cancelling your account for the sole purpose of obtaining a refund and then re-ordering a new account;
         3. Organizing multiple business entities or using assumed business names for the purpose of circumventing these restrictions;
         4. Knowingly providing false or misleading information when you Sign Up for your account; or
         5. Requesting a refund under the 30-Day Guarantee at any time after you have already received a refund under that guarantee.
   5. If you violate any provision of any of the following policies of IndicHosts.net, you will not be eligible for the 30-Day Guarantee:
      1. 1. Terms of Service (TOS);
         2. Acceptable Use Policy (AUP); or
         3. No-Spam Policy (NSP).

Changes to your service, including, but not limited to, adding new services, removing services, or changing the type of hosting plan you have do NOT make you eligible for an additional 30-Day Guarantee. The 30-Day Guarantee applies to your first order of Web hosting services from Indichosts.net, and does not apply to any changes to your service at any time.

7. Customer agrees not to engage in any activity that violates any international, foreign, federal, state, or local laws applicable to the service terms described in this Agreement.

8. IndicHosts.net reserves the right to discontinue service to any Customer it deems, in its sole discretion, violates any condition of service including, but not limited to, the following:

8.1. the Acceptable Use Policy, or

8.2. the No-Spam Policy.

8.3. the Dedicated Server's Terms Of Service.

9. Backups.

9.1. Where backups are included with a service plan, IndicHosts.net uses commercially reasonable efforts to create and retain backups according to the frequency and retention period stated for that plan. On IndicHosts.net's shared and managed hosting platforms this means daily backups, stored off the hosting server in two separate locations and retained for seven (7) days; VPS and dedicated servers are backed up only where a backup service is included in the plan or ordered as an add-on, and the plan specification is definitive. All backup and restoration services are provided on a best-effort basis and are subject to technical feasibility, storage availability, system condition and operational limitations. IndicHosts.net does not apply a general inode-count or account-size exclusion to backup eligibility.

9.2. Even the best and most complete and redundant backup systems can and do fail for a variety of reasons, despite the best efforts of the Web hosting service provider. THEREFORE, INDICHOSTS.NET DOES NOT GUARANTEE THE AVAILABILITY, COMPLETENESS, CURRENCY, OR INTEGRITY OF THESE BACKUPS OR THE DATA THEY CONTAIN. Consequently, you must not rely upon the availability, completeness, currency, or integrity of these backups.

9.3. Customers are responsible for maintaining a current and independently stored backup of all their data — including websites, databases, email, and configuration files — at all times, and IndicHosts.net strongly recommends that Customers regularly verify their own backups and restoration procedures.

9.4. IndicHosts.net does not provide any sort of compensation for lost, inaccurate, incomplete, or outdated data in the event that IndicHosts.net's backups do not function properly, regardless of the reason(s) for any such malfunction, even if the malfunction was due to the fault or negligence of IndicHosts.net or any of its employees or agents, and regardless of whether IndicHosts.net had been informed of the possibility of such malfunction, or any fault or negligence that might cause it, except to the extent that such liability cannot lawfully be excluded or limited under applicable law.

9.5. In the event that you need to recover data from a backup, IndicHosts.net will use reasonable efforts to restore data to your account from the appropriate backup. HOWEVER, PLEASE NOTE THAT THIS SERVICE IS INTENDED TO COMPLEMENT YOUR OWN BACKUPS TO YOUR OWN COMPUTER, AND IS NOT A SUBSTITUTE FOR THOSE BACKUPS. AGAIN, INDICHOSTS.NET DOES NOT GUARANTEE THE AVAILABILITY, COMPLETENESS, CURRENCY, OR INTEGRITY OF ITS BACKUPS.

9.6. You understand and agree that IndicHosts.net's backup policy does not create any warranties for whose breach IndicHosts.net can be held liable.

10. Customer agrees to defend, indemnify, and hold harmless IndicHosts.net, and the parents, subsidiaries, successors, assigns, employees and agents of IndicHosts.net against any losses, claims, damages, liabilities, penalties, actions, proceedings or judgments (collectively, "Losses") to which an indemnified party may become subject and which Losses arise out of, or relate to this Agreement or Customer's use of the Services, and to reimburse an indemnified party for all legal and other expenses, including reasonable attorneys' fees incurred by such indemnified party in connection with investigating, defending, or settling any Loss whether or not in connection with pending or threatened litigation in which such indemnified party is a party.

11. INDICHOSTS.NET SHALL NOT BE LIABLE UNDER ANY CIRCUMSTANCES FOR ANY INDIRECT, INCIDENTAL, SPECIAL OR CONSEQUENTIAL DAMAGES, PUNITIVE OR EXEMPLARY DAMAGES, OR FOR ANY LOSS OF PROFITS, LOSS OF REVENUE, LOSS OF USE, OR LOSS OF DATA RESULTING FROM THE USE OF IndicHosts.net's SERVICES BY CUSTOMER OR ANY THIRD PARTIES, REGARDLESS OF THE FORM OF ACTION OR THEORY OF LIABILITY, OR ANY LOSS OF DATA RESULTING FROM DELAYS, NONDELIVERIES, MISDELIVERIES OR SERVICE INTERRUPTIONS.

12. INDICHOSTS.NET PROVIDES THE SERVICES AND PRODUCTS AS IS, WITHOUT WARRANTY OF ANY KIND, WHETHER EXPRESS OR IMPLIED. INDICHOSTS.NET DISCLAIMS ALL WARRANTIES OF NON-INFRINGEMENT OF ANY THIRD-PARTY RIGHTS, AND DISCLAIMS ALL IMPLIED WARRANTIES, INCLUDING, BUT NOT LIMITED TO, THE IMPLIED WARRANTIES OF MERCHANTABILITY AND FITNESS FOR A PARTICULAR PURPOSE. CUSTOMER SHALL BE SOLELY RESPONSIBLE FOR THE SELECTION, USE, AND SUITABILITY OF THE SERVICES AND IndicHosts.net SHALL HAVE NO LIABILITY THEREFORE.

13. TO THE MAXIMUM EXTENT PERMITTED BY LAW, INDICHOSTS.NET DISCLAIMS, ALL WARRANTIES, REPRESENTATIONS OR OTHER ENDORSEMENTS, EXPRESS OR IMPLIED, WITH REGARD TO THE INFORMATION ACCESSED FROM, OR THROUGH, THIS SERVICE, THE SYSTEMS WHICH PROVIDE IT, AND THE INTERNET, INCLUDING ALL WARRANTIES OF MERCHANTABILITY OR FITNESS FOR A PARTICULAR USE, OR NON-INFRINGEMENT OF ANY THIRD-PARTY RIGHTS.

14. INDICHOSTS.NET DOES NOT ASSUME ANY LIABILITY FOR THE COMPLETENESS, ACCURACY, OR USEFULNESS OF ANY INFORMATION DISCLOSED OR MATERIALS ACCESSED THROUGH ITS SERVICES, ITS SYSTEMS, ITS NETWORKS, OR THE INTERNET.

15. No Waiver of Rights by IndicHosts.net. Any failure by IndicHosts.net to enforce this Agreement in every instance in which it might apply does not amount to a waiver of any of IndicHosts.net's rights.

16. Governing Law and Dispute Resolution.

16.1. Governing law. This Agreement is governed by and construed in accordance with the laws of India, without regard to conflict-of-law rules.

16.2. Dispute escalation. Before starting formal proceedings, Customer agrees to first raise any dispute with IndicHosts.net in writing (a "Dispute Notice"), sent to the notice address in Section 17.2 or to the billing or support desk. The parties will attempt in good faith to resolve the dispute within thirty (30) days of the Dispute Notice.

16.3. Arbitration. Any dispute not resolved under Section 16.2 shall be referred to and finally resolved by arbitration under the Arbitration and Conciliation Act, 1996, as amended, as follows: (a) the tribunal shall consist of a sole arbitrator appointed by mutual agreement of the parties within thirty (30) days of a written demand for arbitration, failing which the arbitrator shall be appointed in accordance with Section 11 of that Act; (b) the seat and venue of the arbitration shall be New Delhi, India; (c) the language of the arbitration shall be English; (d) the costs of the arbitration shall be allocated by the arbitrator in accordance with Section 31A of that Act; (e) either party may seek interim relief from the arbitrator under Section 17 of that Act or from the courts at New Delhi under Section 9 of that Act, and doing so is not a waiver of this arbitration agreement; and (f) the award shall be final and binding, and judgment upon the award may be entered in any court of competent jurisdiction.

16.4. Courts. Subject to Sections 16.3 and 16.5, the courts at New Delhi, India have exclusive jurisdiction over matters that cannot be referred to arbitration, applications for interim relief, and the enforcement of arbitral awards. This Agreement is deemed to have been made in New Delhi, India.

16.5. Consumer remedies preserved. Nothing in this Section 16 limits or excludes any right or remedy available to Customer as a consumer under the Consumer Protection Act, 2019, or any other law that cannot be limited or excluded by agreement, including the right to approach the consumer dispute redressal commissions.

17. Notices.

17.1. From IndicHosts.net to Customer. IndicHosts.net will notify you by email of any notices that IndicHosts.net is required to provide to you under this Agreement, at the most current email address you have provided to IndicHosts.net.

By entering this Agreement, you consent to receive notices by email. You are solely responsible for ensuring that IndicHosts.net has your most current email address, and IndicHosts.net shall not be responsible for any lost, misdirected, bounced, forwarded, or undeliverable email that IndicHosts.net sends to the most current email address you have provided to IndicHosts.net.

17.2. From Customer to IndicHosts.net. Unless otherwise specified in this Agreement, notices to IndicHosts.net shall be sent to the following address: IndicHosts.net, Attention: Legal Notices, 207 Sethi Bhawan, Rajendra Place, New Delhi 110008, India

18. Governing Law. [Consolidated into Section 16 — see Section 16.1.]

19. Currency. All monetary amounts to which this Agreement refers shall be in United States dollars and/or Indian Rupees.

20. Entire Agreement. This Agreement, including all of its component parts, comprises the entire agreement between you (the Customer) and Indichosts.net, and supersedes any prior or previous agreements between you and IndicHosts.net with respect to the subject matter of this Agreement; provided, however, that you agree that you shall be subject to any additional terms and conditions of which IndicHosts.net notifies you from time to time, pursuant to this Agreement.

21. No Oral Modification of this Agreement. This Agreement may not be modified orally.

22. Assignment.

22.1 Customer shall not assign or attempt to assign its obligations under this Agreement without IndicHosts.net's prior and express written consent to such assignment.

22.2. IndicHosts.net may assign any or all of its rights and obligations under this Agreement at any time without prior notice to or consent of Customer.

23. Consent to Jurisdiction; Venue. [Consolidated into Section 16 — see Sections 16.3 and 16.4.]

24. Choice of Law. [Consolidated into Section 16 — see Sections 16.1 and 16.4.]

25. Force Majeure. IndicHosts.net shall not be liable or deemed to be in default for any delay or failure in performance under this Agreement or interruption of service resulting directly or indirectly from acts of God, civil or military authority, acts of public enemy, war, terrorism, riots, civil disturbances, insurrections, accidents, fire, explosions, earthquakes, floods, the elements, strikes, labor disputes, shortages of suitable parts, materials, labor or transportation, magnetic interference, interruptions of electrical power or other utility service, unavailability of any telecommunications or wireless service or connection to any telecommunications or wireless service, or any cause beyond the reasonable control of IndicHosts.net.

26. Severability of Terms of this Agreement. In the event that any portion of this Agreement is held to be unenforceable, the unenforceable portion shall be construed in accordance with applicable law as nearly as possible to reflect the original intentions of the parties hereto, and the remainder of the provisions shall remain in full force and effect.

27. Limitation of Actions Arising Under this Agreement. Any cause of action you may have with respect to IndicHosts.net's performance or alleged non-performance of this Agreement must be commenced within one (1) year after the claim or cause of action arises or such claim or cause of action is forever barred.

28. Denial of Service IndicHosts.net reserves the right to refuse or discontinue service to anyone at our sole discretion.

29. Abuse of IndicHosts.net Staff or Support Personnel.

29.1. At IndicHosts.net, we take pride in providing excellent service to all of our customers. It is our policy always to treat our customers with the highest level of respect and courtesy. In return, we expect the same respect and courtesy from you.

29.2. If our staff feels that you are consistently engaging in abusive content toward them, or addressing them in a demeaning or rude manner, your account(s) may be suspended and you may be asked to take your business elsewhere.

30. Version, Effective Date and Acceptance.

30.1. This Agreement carries a version number and effective date, shown at the top of this page. The version in force when Customer places an order governs that order; a renewal is governed by the version in force at the time of renewal.

30.2. When Customer places an order, acceptance of this Agreement is recorded in IndicHosts.net's billing system together with the account identity, the date and time, and the version accepted.

30.3. IndicHosts.net may update this Agreement. Material changes are notified to existing Customers by email at least thirty (30) days before their effective date; continued use of the Services or renewal after the effective date constitutes acceptance of the updated Agreement. The current version is always published at this page.

Appendix A:

When you buy from the Company a third-party product or service, you agree to this Agreement AND the terms and conditions of the third-party product or service included in this Agreement. Where your plan includes cPanel/WHM, your use of the software is additionally conditioned on acceptance of the cPanel End User License Agreement, and cPanel trademarks may be used only as cPanel's Trademark Usage Policy permits (IndicHosts.net is a registered cPanel Partner).
